Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana keabsahan pernikahan yang dilakukan secara online, menganalisis keabsahan perkawinan yang dilakukan secara online melalui media elektronik pada masa pandemi Covid-19 menurut Undang-Undang Nomor 16 Tahun 2019 Tentang Perubahan Atas Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan serta menganalisis implikasi hukum yang timbul dari adanya perkawinan yang dilakukan secara online melalui media elektronik pada masa pandemi Covid-19. Penelitian merupakan penelitian hukum normatif berupa penelitian kepustakaan yang menggunakan 3 (tiga) bahan hukum yaitu bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Hasil penelitian bahwa Hukum akad pernikahan melalui Video Call dalam kajian hukum perkawinan Indonesia dalam Undang-Undang Perkawinan memenuhi rukun dan syarat pernikahan. Kedudukan ijab qabul dalam pernikahan Video Call ini sesuai dengan ketentuan hukum pada umumnya meskipun pernikahan yang dilangsungkan secara Video Call ini terpisah secara tempat, pihak pertama di satu kota dan pihak keduanya berada di kota lain. Akad nikah melalui Video Call terdapat dua penafsiran dalam keabsahannya, selama belum ada ketegasan dari lembaga penegak hukum yang diberlakukan maka akad nikah sah selama proses terjadinya ijab kabul tidak ada keraguan dan memenuhi rukun dan syarat dalam pelaksanaannya. Akibat hukum akad pernikahan melalui Video Call dalam kajian hukum perkawinan Indonesia yang pelaksanaan perkawinan memenuhi syarat dan rukun perkawinan serta tidak bertentangan dengan kompilasi hukum Islam, maka perkawinan tersebut sudah sah. Hal ini dikuatkan dengan ketentuan pasal 27 Kompilasi Hukum Islam berbunyi: “Ijab dan kabul antara wali dan calon mempelai pria harus jelas beruntun dan tidak berselang waktu, sampai Pasal 29 Kompilasi Hukum Islam antara lain tidak berselang waktu, kemudian dilakukan sendiri oleh wali nikah yang bersangkutan dan diucapkan langsung oleh mempelai laki-laki melalui Video Call kemudian semua aspek perkawinan terpenuhi antara lain rukun, syarat sah, syarat-syarat perkawinan. Mengakibatkan yang timbul dalam pelaksanaan akad nikah melalui Video Call yaitu penandatanganan akta nikah inilah yang menjadi akibat hukum karena kedudukan kedua mempelai dan saksi yang terpisah satu sama lain. Maka hal inilah yang dapat menghambat kepastian hukum bagi kedua mempelai karena belum adanya salah satu tanda tangan dari mempelai, akta nikah belum dapat dikatakan sempurna atau mempunyai kekuatan hukum meskipun perkawinannya sendiri dapat dikatakan sah menurut agama dan kepercayaan masing-masing. This study aims to find out how the validity of marriages carried out online, analyze the validity of marriages conducted online through electronic media during the Covid-19 pandemic according to Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage and analyze the legal implications arising from marriages conducted online through electronic media during the Covid-19 pandemic. This research is a normative legal research in the form of library research that uses 3 (three) legal materials, namely primary legal materials, secondary legal materials, and tertiary legal materials. The results of the study show that the marriage contract law through Video Call in the study of Indonesian marriage law in the Marriage Law fulfills the pillars and requirements of marriage. The position of the ijab qabul in this Video Call marriage is in accordance with legal provisions in general, although the marriage which is held by Video Call is separated by location, the first party is in one city and the second party is in another city. Marriage contracts through Video Calls have two interpretations in their validity, as long as there is no firmness from law enforcement agencies that is enforced, the marriage contract is valid during the process of consent and acceptance there is no doubt and fulfills the pillars and conditions in its implementation. The legal consequences of marriage contracts through Video Calls in the study of Indonesian marriage law where the implementation of marriage meets the requirements and pillars of marriage and does not conflict with the compilation of Islamic law, then the marriage is legal. This is confirmed by the provisions of Article 27 of the Compilation of Islamic Law which reads: "Ijab and Kabul between the guardian and the prospective groom must be clear successively and do not lapse of time, until Article 29 of the Compilation of Islamic Law, among others, does not take time, then is carried out by the guardian of the marriage concerned. and spoken directly by the groom through a Video Call then all aspects of the marriage are fulfilled, including the pillars, legal requirements, and marriage conditions. As a result, what arises in the implementation of the marriage contract through Video Call, namely the signing of the marriage certificate, is a legal consequence because the positions of the bride and groom and witnesses are separated from each other. So this is what can hinder legal certainty for the bride and groom because there is no signature from the bride and groom, the marriage certificate cannot be said to be perfect or has legal force even though the marriage itself can be said to be valid according to their respective religions and beliefs.
