Abstract

Anak sebagai generasi muda, mewarisi cita-cita luhur bangsa,pemimpin masa depan negara, dan harapan generasi sebelumnya, perlu dilindungi agar mendapatkan kesempatan yang luas agar tumbuh, dan berkembang secara wajar. Perlindungan anak merupakan upaya dan tindakan seluruh strata sosial dalam kedudukan dan peran yang berbeda-beda, yang menyadari sepenuhnya pentingnya anak bagi masa depan tanah air dan bangsa. Penelitian ini difokuskan pada dua rumusan masalah, yaitu bagaimana implementasi perlindungan anak korban eksploitasi ekonomi berdasarkan Peraturan Daerah Kota Banjarmasin Nomor 17 Tahun 2014 tentang Perlindungan Anak, kemudian terkait apa saja kendala dalam pemberian perlindungan khusus anak korban eksploitasi ekonomi berdasarkan Peraturan Daerah Kota Banjarmasin Nomor 17 Tahun 2014 tentang Perlindungan Anak. Penelitian ini merupakan penelitian empiris, yang bersifat kualitatif. Populasi penelitian adalah Satuan Polisi Pamong Praja Kota Banjarmasin, Dinas Sosial Kota Banjarmasin, dan Dinas Pemberdayaan Perempuan dan Perlindungan Anak Kota Banjarmasin. Teknik Pengumpulan data menggunakan teknik observasi, dan wawancara. Data-data yang diperoleh dalam penelitian ini dianalisis dengan metode deskriptif kualitatif. Dari penelitian ini diperoleh hasil bahwa eksploitasi anak merupakan tindakan memanfaatkan anak-anak untuk kepentingan ataupun keuntungan orang tua maupun orang lain. Eksploitasi ekonomi yang sering terjadi berupa menjadikan anak dibawah umur berjualan dipinggir jalan, sebagai pengemis, pengamen, ataupun badut jalanan baik dengan ataupun tanpa persetujuan si anak sendiri, sehingga hak mereka untuk tumbuh, berkembang dan berpartisipasi terhambat. Children as the younger generation, inheriting the nation's noble ideals, the country's future leaders, and the hopes of previous generations, need to be protected in order to get broad opportunities to grow and develop properly. Child protection is the effort and action of all social strata in different positions and roles, who are fully aware of the importance of children for the future of the homeland and the nation. This research is focused on two formulations of the problem, namely how to implement the protection of children who are victims of economic exploitation based on Regional Regulation of the City of Banjarmasin Number 17 of 2014 concerning Child Protection, then regarding what are the obstacles in providing special protection for children who are victims of economic exploitation based on Regional Regulation of the City of Banjarmasin Number 17 of 2014 2014 concerning Child Protection. This research is an empirical research, which is qualitative in nature. The study population was the Civil Service Police Unit of Banjarmasin City, Banjarmasin City Social Service, and the Banjarmasin City Office of Women's Empowerment and Child Protection. Data collection techniques using observation techniques, and interviews. The data obtained in this study were analyzed using a qualitative descriptive method. From this research, it was found that child exploitation is an act of using children for the benefit or benefit of parents or other people. Economic exploitation that often occurs is in the form of making minors sell on the side of the road, as beggars, buskers, or street clowns either with or without the consent of the children themselves, so that their rights to grow, develop and participate are hampered.
