Abstract

Bermula dari maraknya isu mengenai masih adanya dugaan kasus prostitusi di Banjarbaru meski sudah dilakukan penutupan lokasi oleh pemerintah, baik yang terekspos oleh media maupun tidak. Padahal, sudah dibentuk Perda Nomor 6 Tahun 2002 Tentang Pemberantasan Pelacuran. Penerapannya belum berhasil karena masih banyak yang melanggar aturan tersebut. Hal itu disebabkan lantaran sanksi hukuman pidananya yang terlalu ringan sedangkan sanksi sosialnya, dapat dikatakan sangat jarang. Sehingga, tidak ada efek jera terhadap pelaku. Selama ini, perda tersebut dapat dibilang tidak efektif karena beberapa faktor pendukung lainnya. Misalnya, masih adanya bocoran informasi dari oknum tertentu ketika akan dilaksanakan razia, praktik prostitusi ini masih dilakukan secara bersembunyi, kemudian lingkungan setempat juga masih mendukung. Penelitian ini merupakan penelitian normatif, data penelitiannya bersifat kuantitatif sedangkan sifat penelitiannya yaitu deskriptif analitis. Penelitian ini difokuskan pada dua rumusan masalah, yaitu bagaimana penegakan hukum tindak pidana prostitusi berdasarkan Perda Nomor 6 Tahun 2002 tentang Pemberantasan Pelacuran dan bagaimana sanksi hukum bagi pelaku hukum tindak pidana prostitusi berdasarkan Perda Nomor 6 Tahun 2002 tentang Pemberantasan Pelacuran. Dari penelitian ini diperoleh hasil bahwa penegakan hukum terhadap tindak pidana prostitusi di Banjarbaru sudah diupayakan semaksimal mungkin oleh pemerintah. Namun, memang beberapa faktor penghambat masih menjadi permasalahan selama ini. Starting from the rise of rumors regarding the existence of alleged cases of prostitution in Banjarbaru, despite the closure of the location by the government, whether exposed by the media or not. In fact, Regional Regulation No. 6 of 2002 on the Eradication of Prostitution has been enacted. Its implementation has not been successful because there are still many who violate these rules. This is because the criminal sanctions are too light, while the social sanctions are very rare. Thus, there is no deterrent effect on the perpetrators. So far, the regulation has been practically ineffective due to several other supporting factors. For example, there are still leaks of information from certain individuals when raids are to be carried out, the practice of prostitution is still carried out in secret, and the local environment is also still supportive. This research is a normative research, the research data is quantitative, while the nature of the research is analytical descriptive. This research focuses on two problem formulations, namely how to enforce the law on the crime of prostitution based on the Regional Regulation Number 6 of 2002 concerning the Eradication of Prostitution and how the legal sanctions for the perpetrators of the criminal act of prostitution are based on the Regional Regulation Number 6 of 2002 concerning the Eradication of Prostitution. From this study, it was found that law enforcement against the crime of prostitution in Banjarbaru has been made as much as possible by the government. However, some inhibiting factors are still a problem so far.
