Abstract

Macam-macam usaha aturan yang dilaksanakan meneruskan pengendalian untuk warga seperti akseptor bantuan, dan Tenaga Kefarmasian seperti penyumbang bantuan, sudah pernah dilaksanakan, namun lagi kurang mencukupi lantaran pertumbuhan pandangan dan teknologi yang melambung pesat tidak sebanding dengan perkembangan aturan. Sementara itu, hambatan tempat pembeli supaya menerima pengendalian peraturan menurut ketertarikan pengelolanya, serta diakibatkan oleh undang-undang yang menaungi pembeli tdak dapat meneruskan tentram, atau seadanya memuaskan tentu segera menaungi kebutuhan pembeli. Ada dua rumusan masalah pada penelitian, yaitu bentuk pengendalian peraturan untuk pembeli yang menemui masa sulit atas pembelian obat keras tanpa resep di apotek dan pertanggungjawaban petugas apotek yang tetap mendagangkan obat keras tanpa resep dari dokter. Agar menjawab perbahasan dan tujuan analisis, menggunakan meetode normatif yang diterapkan dalam analisis peraturan yang dilaksanakan dengan metode analisis petunjuk artikel yang ada. Macam bahannya ialah melingkupi bahan Primer dan bahan Sekunder yang digabungkan melingkupi ulasan analisis. Dari hasil analisis pembahasan bentuk perlindungan hukum pembeli yang mengalami kerugian dalam pembelian obat keras tanpa resep di apotek, berdasarkan pada pasal 4 huruf (h) Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen mengenai hak konsumen menyatakan bahwa pembeli berwenang menerima ganti rugi atas kerugian barang yang digunakan. Bentuk pertanggungjawaban petugas apotek yang tetap memperdagangkan obat keras tanpa resep dari dokter, konsumen yang merasa dirugikan akibat petugas apotek yang tidak memberikan informasi dengan jujur pada saat konsumen membeli obat keras daftar G di apotek, peetugas apotek yang bersangkutan harus melakukan pertanggungjawaban sesuai ketentuan pada Pasal 19 Undang-Undang Nomor 8 Tahun 1999 Perlindungan Konsumen. There are two problem formulations in the research, namely the form of regulatory control for buyers who are having a hard time buying hard drugs without a prescription at pharmacies and the responsibility of pharmacists who continue to trade hard drugs without a prescription from a doctor. In order to answer the discussion and the purpose of the analysis, using the normative method applied in the regulatory analysis which is carried out with the analysis method of the existing article guidelines. The types of materials include primary materials and secondary materials combined to include analytical reviews. From the results of the analysis of the discussion of the form of legal protection for buyers who experience losses in purchasing hard drugs without a prescription at pharmacies, based on article 4 letter (h) of Law Number 8 of 1999 concerning Consumer Protection regarding consumer rights, it is stated that buyers are authorized to receive compensation for losses. used goods. The form of responsibility of pharmacy officers who continue to trade hard drugs without a doctor's prescription, consumers who feel aggrieved as a result of pharmacy officers who do not provide honest information when consumers buy list G hard drugs at pharmacies, the pharmacist concerned must carry out accountability according to the provisions in Article 19 Law Number 8 of 1999 on Consumer Protection.
