Abstract

Penelitian ini bertujuan Untuk mengetahui bentuk perlindungan hukum terhadap korban pencemaran nama baik melalui media social dan untuk Mengetahui tanggungjawab pidana bagi pelaku pencemaran nama baik melalui media sosial. Jenis penelitian dalam penulisan skripsi ini dilakukan dengan jenis penelitian hukum normatif berupa penelitian kepustakaan yang menggunakan 3 bahan hukum yaitu bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Penelitian hukum ini menitikberatkan pada studi kepustakaan yang berarti akan lebih banyak menelaah dan mengkaji aturan-aturan hukum yang ada dan berlaku. Hasil penelitian menunjukan Perlindungan hukum terhadap korban cyber crime tentunya sangat diperlukan, hal ini bertujuan untuk dapat menjaga korban dengan baik selain untuk menghukum pelaku. Hal ini dikarenakan dengan melihat fenomena yang terjadi saat ini banyak para korban yang tidak melaporkan kepada aparat penegak hukum, sehingga hak-hak yang dimiliki oleh korban pada akhirnya tidak terpenuhi dengan baik. Indonesia sebagai negara hukum sesuai dengan amanah konstitusi, sudah sepatutnya melindungi setiap warga negaranya dari setiap tindakan yang dapat merugikan apalagi dapat merusak kehidupan bernegara melalui suatu aturan-aturan hukum yang baku. Setiap korban kejahatan memiliki hak untuk dapat dilindungi pula sebagaimana diatur didalam Undangundang nomor 31 Tahun 2014 Tentang Perubahan atas Undang-undang Nomor 13 Tahun 2006 Tentang Perlindungan Saksi dan Korban. Pencemaran nama baik melalui media sosial diatur dalam Pasal 27 Ayat (3) Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Ancaman pidana bagi seseorang yang memenuhi unsur dalam pasal 27 Ayat (3) diatur dalam pasal 45 ayat (3) Undang-undang Nomor 19 Tahun 2016 tentang Perubahan Atas UndangUndang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, yaitu pidana penjara paling lama 4 tahun dan atau denda paling banyak 750.000.000 (tujuh ratus lima puluh juta rupiah). Ketentuan pidana tentang pencemaran nama baik dalam Undang-Undang ITE jauh lebih berat dibandingkan dengan ketentuan pidana dalam KUHP. This study aims to determine the form of legal protection for victims of defamation through social media and to determine criminal responsibility for perpetrators of defamation through social media. The type of research in writing this thesis is carried out with normative legal research in the form of library research using 3 legal materials, namely primary legal materials, secondary legal materials and tertiary legal materials. This legal research focuses on literature study, which means it will study more and examine the existing and applicable legal rules. The results of the study show that legal protection for victims of cyber crime is certainly very necessary, it aims to be able to protect victims well in addition to punishing the perpetrators. This is because by looking at the current phenomenon, many victims do not report to law enforcement officials, so that the rights of the victims are not properly fulfilled in the end. Indonesia as a state of law in accordance with the mandate of the constitution, it is proper to protect every citizen from any actions that can harm, let alone damage the life of the state through a standard rule of law. Every crime victim has the right to be protected as well as regulated in Law Number 31 of 2014 concerning Amendments to Law Number 13 of 2006 concerning Protection of Witnesses and Victims. Defamation through social media is regulated in Article 27 Paragraph (3) of Law Number 11 of 2008 concerning Information and Electronic Transactions. Criminal threats for someone who fulfills the elements in Article 27 Paragraph (3) is regulated in Article 45 paragraph (3) of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions, namely imprisonment for a maximum of 4 years and or a maximum fine of 750,000,000 (seven hundred and fifty million rupiah). The criminal provisions regarding defamation in the ITE Law are much more severe than the criminal provisions in the Criminal Code.
