Abstract

Negara indonesia merupakan negara hukum, istilah tersebut telah dinyatakan didalam Undangundang Negara Kesatuan Republik Indonesia Tahun 1945 di dalam pasal 1 Ayat 3 yang berbunyi bahwa Negara Indonesia adalah negara hukum. Kebebebasan berekspresi dan berpendapat di Indonesia yang diiringi dengan akses media informasi dan komunikasi via internet dan media sosial telah membuat suatu perubahan komunikasi antar manusia ke manusia lainnya, kemudahan akses internet dan informasi memudahkan setiap orang untuk mengeluarkan opini dan pendapatnya kepada orang itu sendiri. Namun saat perkembangan tekhnologi tidak hanya berupa memberikan dampak positif saja, namun juga memberikan dampak negatif nya, tindak pidana penghinaan atau ujaran kebencian (hate speech) serta penyebaran informasi di media sosial yang ditujukan untuk menimbulkan rasa kebencian atau permusuhan antar individu berdasarkan suku, agama, ras, dan antar golongan (SARA). Penelitian ini memiliki dua rumusan masalah, yaitu Bagaimana kedudukan hukum tentang kebebasan berekspresi di media sosial menurut hukum positif di Indonesia dan Bagaimana batasan kebebasan berekspresi di media sosial menurut hukum positif di Indonesia. Penelitian ini merupakan penelitian yuridis normatif, yang bersifat kualitatif. Dengan teknik pengumpulan data library research, dan dilengkapi data primer hasil analisis Undang-Undang Dasar 1945, berbagai peraturan perundang-undangan dan data sekunder dari referensi-referensi buku, artikel, karya ilmiah, jurnal, dan website. Dari penelitian ini diperoleh hasil yang pertama mengenai kedudukan hukum kebebasan berekspresi yang di atur dalam Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik meskipun peraturan tersebut tidak tersirat secara langsung tetapi Undang-Undang ini sudah mengatur tentang batasan berekspresi di media sosial itu sendiri, dan yang kedua yaitu pembatasan kebebasan berekspresi diatur dalam Kitab Undang-Undang Hukum Pidana (KUHP) pasal 207 dan 208, Undang-Undang Nomor 19 tahun 2016 pasal 27 dan 28, dan pada Surat Edaran Kapolri NO SE/06/X/2015. The state of Indonesia is a state of law, the term has been stated in the 1945 Constitution of the Republic of Indonesia in Article 1 Paragraph 3 which reads that the State of Indonesia is a state of law. Freedom of expression and opinion in Indonesia, which is accompanied by access to information and communication media via the internet and social media, has made a change in communication between humans to other humans, the ease of access to the internet and information makes it easier for everyone to express their opinions and opinions to the person himself. However, when the development of technology is not only in the form of having a positive impact, but also having a negative impact, criminal acts of insult or hate speech and the dissemination of information on social media aimed at causing hatred or hostility between individuals based on ethnicity, religion, race, and between groups. This study has two problem formulations, namely how is the legal position regarding freedom of expression on social media according to positive law in Indonesia and how is the limitation of freedom of expression on social media according to positive law in Indonesia. This research is a normative juridical research, which is qualitative. With library research data collection techniques, and equipped with primary data from the analysis of the 1945 Constitution, various laws and regulations and secondary data from book references, articles, scientific works, journals, and websites. From this study, the first results were obtained regarding the legal position of freedom of expression which is regulated in Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions although the regulation is not implied directly but this Law already regulates the limitations of expression on social media itself, and secondly, the restrictions on freedom of expression are regulated in the Criminal Code (KUHP) articles 207 and 208, Law Number 19 of 2016 articles 27 and 28, and in Circular Letters National Police Chief NO SE/06/X/2015.
