Abstract

Penelitian ini bertujuan untuk mendiskripsikan tentang malpraktek dan melakukan pembahasan dalam perspektif hukum pidana dan hukum perdata di Indonesia. Jenis penelitian yang digunakan adalah penelitian hukum normatif, yaitu penelitian yang berfokus pada norma dan penelitian ini memerlukan bahan hukum sebagai data utama. Dalam Kitab Undang-Undang Hukum Pidana, pertanggungjawaban pidana dapat dikenakan atas malpraktek yaitu Pasal 90, Pasal 359, Pasal 360 ayat (1) dan (2) serta Pasal 361. Yang dikenakan pasal ini salahsatunya adalah dokter, bidan, ahli-obat, yang sebagai orang ahli dalam pekerjaan mereka masing-masing dianggap harus lebih berhati-hati dalam melakukan pekerjaannya. Adapun dalam Undang-undang Nomor 36 tahun 2009 Tentang Kesehatan tidak dicantumkan pengertian tentang Malpraktek, namun didalam Ketentuan Pidana diatur pada Bab XX diatur didalam Pasal 190. Dalam Hukum Perdata Indonesia atas malpraktek pada hakikatnya ada 2 (dua) bentuk pertanggungjawaban dokter sebagai bentuk perlindungan terhadap pasien jika terjadi malpraktek. Korban malpraktek dapat menggugat dokter atas perbuatannya dalam pelaksanaan perjanjian terapeutik berdasarkan Pasal 1366 KUH Perdata. Pertanggungjawaban seorang dokter yang telah melakukan malpraktek dalam hal ini dapat dilihat dalam Pasal 1367 BW yang membawa akibat bahwa yang bersalah (yaitu yang menimbulkan kerugian pada pihak lain) harus membayar ganti rugi (schadevergoeding). Perlindungan hukum terhadap korban malpraktek kedokteran sebagai konsumen dapat dilihat dalam ketentuan Pasal 19 Ayat (1) UU No 8 Tahun 1999. Berdasarkan ketentuan Pasal 19 Ayat (1), kerugian yang diderita korban malpraktek sebagai konsumen jasa akibat tindakan medis yang dilakukan oleh dokter sebagi pelaku usaha jasa dapat dituntut dengan sejumlah ganti rugi. Bentuk perlindungan hukum terhadap korban malpraktek kedokteran yang diatur dalam UU No 36 Tahun 2009 yaitu berupa pemberian hak kepada korban malpraktek untuk menuntut pertanggungjawaban dokter yang melakukan malpraktek kedokteran. Adapun bentuk perlindungan hukum terhadap korban malpraktek kedokteran yang diatur dalam UU No. 29 Tahun 2009 tentang Praktik Kedokteran, yaitu berupa pemberian hak kepada korban malpraktek untuk melakukan upaya hukum pengaduan kepada Ketua Majelis Kehormatan Disiplin Kedokteran Indonesia. This study aims to describe malpractice and conduct a discussion in the perspective of criminal law and civil law in Indonesia. The type of research used is normative legal research, namely research that focuses on norms and this research requires legal materials as the main data. In the Criminal Code, criminal liability can be imposed on malpractice, namely Article 90, Article 359, Article 360 paragraphs (1) and (2) and Article 361. One of the subjects imposed by this article is a doctor, midwife, medical expert, who as experts in their respective jobs are considered to have to be more careful in doing their jobs. As for Law Number 36 of 2009 concerning Health, there is no definition of Malpractice, but in the Criminal Provisions regulated in Chapter XX, it is regulated in Article 190. In Indonesian Civil Law on malpractice, in essence there are 2 (two) forms of doctor's responsibility as a form of protection against malpractice. patient in case of malpractice. Victims of malpractice can sue doctors for their actions in the implementation of therapeutic agreements based on Article 1366 of the Civil Code. The responsibility of a doctor who has committed malpractice in this case can be seen in Article 1367 BW which has the result that the guilty (i.e. causing harm to the other party) must pay compensation (schadevergoeding). Legal protection for victims of medical malpractice as consumers can be seen in the provisions of Article 19 Paragraph (1) of Law No. 8 of 1999. Based on the provisions of Article 19 Paragraph (1), the losses suffered by victims of malpractice as consumers of services are due to medical actions carried out by doctors as perpetrators. service businesses can be sued for a number of damages. The form of legal protection for victims of medical malpractice as regulated in Law No. 36 of 2009 is in the form of granting rights to malpractice victims to demand accountability from doctors who commit medical malpractice. The form of legal protection for victims of medical malpractice is regulated in Law no. 29 of 2009 concerning Medical Practice, which is in the form of granting rights to malpractice victims to make legal remedies for complaints to the Chairperson of the Indonesian Medical Discipline Honorary Council.
