Abstract
Situasi pandemi Covid-19 di Indonesia terus memburuk. Tidak hanya masyarakat umum, perjuangan melawan virus corona juga membuat tenaga medis berguguran. Berdasarkan data yang telah dipublikasikan di berbagai media massa, beberapa Tenaga medis yang meninggal dunia merupakan Tenaga medis yang membuka praktik pribadi. Jadi, ada kemungkinan Tenaga medis tidak menyadari bahwa pasien merupakan carier Covid-19. Oleh karena itu, dalam situasi seperti ini harus diutamakan unsur kehati-hatian Tenaga medis dalam mengemban profesinya. Selain itu banyak terjadi penuduhan bahwa tenaga medis mengcovidkan pasien Tujuan pada penelitian ini untuk mengetahui pertanggungjawaban hukum tenaga medis di Rumah Sakit Pada Masa Pandemi Covid-19. Untuk mengetahui bentuk perlindungan hukum bagi tenaga medis di Rumah Sakit Pada Masa Pandemi Covid-19. Hasil penelitian menunjukan Tanggung jawab hukum yang berkaitan dengan pasien/ konsumen jasa medis, diantaranya: Tanggung jawab hukum perdata dokter kepada pasien karena wanprestasi terkait dengan syarat sahnya suatu perjanjian yang diatur dalam Pasal 132O Kitab Undang-Undang Hukum Perdata. Perlindungan hukum tenaga medis dalam penanganan Covid-19, tampak dalam fakta bahwa tenaga medis tersebut telah mendapatkan perlindungan hukum dalam bentuk pengawasan dan pembinaan yang dilaksanakan oleh Pemerintah Daerah dan Instansi Kerja mereka dalam penanganan Covid-19. Implementasi perlindungan hukum bagi tenaga kesehatan secara tidak langsung tergambar dalam hak yang diberikan kepada Pemerintah, di antaranya; memperoleh makanan, vitamin, dan APD selama bertugas meskipun insentif dan santunan kematian belum didapatkan oleh mereka. Antara Pemerintah dan tenaga kesehatan, keduanya harus saling melengkapi untuk menciptakan keseimbangan hak dan kewajiban melalui upaya preventif dan represif, namun upaya perlindungan hukum yang diberikan masih terdapat kelemahan karena sebagian hak tenaga kesehatan belum terpenuhi. Artinya bahwa, Pemerintah dalam hal ini belum mampu secara maksimal memberikan perlindungan hukum tersebut terhadap tenaga kesehatan yang bertugas dalam gugus tugas percepatan penaganan Covid-19 The situation of the Covid-19 pandemic in Indonesia continues to worsen. Based on data that has been published in various mass media, some medical personnel who died were medical personnel who opened private practices. So, it is possible that medical personnel do not realize that the patient is a carrier for Covid-19. Therefore, in a situation like this one must prioritize the element of caution for medical personnel in carrying out their profession. In addition, there have been many accusations that medical personnel covided patients The purpose of this study was to determine the legal accountability of medical personnel in hospitals during the Covid-19 pandemic. To find out the form of legal protection for medical personnel at the hospital during the Covid-19 pandemic. The results of the study show legal responsibility relating to patients / consumers of medical services, including: Civil liability of doctors to patients for default related to the validity of an agreement stipulated in Article 132O of the Civil Code. Legal protection for medical personnel in handling Covid-19 is evident in the fact that these medical personnel have received legal protection in the form of supervision and guidance carried out by the Regional Government and their Work Agencies in handling Covid-19. The implementation of legal protection for health workers is indirectly reflected in the rights granted to the Government, including; obtain food, vitamins, and PPE while on duty even though incentives and death benefits have not been obtained by them. Between the government and health workers, both must complement each other to create a balance of rights and obligations through preventive and repressive measures, however, the legal protection measures provided still have weaknesses because some of the rights of health workers have not been fulfilled. This means that, in this case, the Government has not been able to optimally provide legal protection for health workers who are assigned to the task force to accelerate the handling of Covid-19.
